Terms of Use
These Terms of Use (“Terms”) form a binding agreement between you (“you”) and the developer of Scanny, the seller named on the App’s App Store product page (“we”, “us”, or “our”), and govern your access to and use of Scanny (distributed as “Sherlock” in some App Store regions), the mobile application (the “App”), together with its related services and the website at scanny.online (collectively, the “Service”).
PLEASE READ THESE TERMS CAREFULLY. THEY CONTAIN IMPORTANT LIMITATIONS ON OUR LIABILITY, A DISCLAIMER OF WARRANTIES, SAFETY WARNINGS ABOUT RELYING ON IDENTIFICATIONS, STRICT RULES ON HOW YOU MAY USE THE SERVICE, AND — DEPENDING ON YOUR JURISDICTION — A BINDING ARBITRATION AGREEMENT AND CLASS-ACTION WAIVER (SECTION 18).
By downloading, installing, accessing, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old and capable of forming a binding contract to use the Service. The Service is intended for adults only, because some of its features search the web for photos of people. By using the Service you represent and warrant that you meet these requirements and that you are not barred from using the Service under the laws of any applicable jurisdiction.
2. Description of the Service
Scanny is a photo-recognition app: you take a photo or choose one from your device, and the Service tells you what is in it. Depending on the version of the App, your region, and the features we have enabled at the time, the Service may include:
- Scanner. Identifies the main subject of a photo — for example a plant, mushroom, insect, or animal; a dish; a product; a car; a landmark; a painting or sculpture; a coin or banknote; a wine or other drink label; a collectible; or a rock or mineral — and can read out and translate text such as signs, menus, labels, and documents. A result may include a name and likely alternatives, short facts, safety notes, estimates (such as nutrition, plant care, or typical value), information about a place, links to encyclopedias, catalogs, maps, and online shops, and a section of similar photos found on the web.
- Face search. You frame a face in a photo, and the Service looks for publicly accessible web pages where a visually similar face, or the same picture, appears. Results are links, each with the website, a preview image, and, where available, the public handle or page title shown for that link and a similarity score.
- “On this photo.” Next to a face search, a short description of the photo and the things in it (for example, clothing and accessories) and, after a paid face search, an indicative starting price for one or two of those things.
Results are produced by automated systems, including artificial-intelligence models and third-party search, identification, and data providers. The Service does not tell you who a person is: when a photo shows a person, the scanner describes only what is visible, and a face search returns links to third-party web pages, not an identification. We may filter out certain results (for example, adult content), and we may modify, add, or discontinue features at any time.
The Service is provided for lawful, personal, non-commercial use only.
3. No accounts; device identity
The Service does not use traditional accounts. Your installation is identified by a randomly generated identifier stored on your device, and your coins, any remaining subscription allowance, and your history are linked to that identifier. You are responsible for all activity that occurs through your installation and device, and you must keep your device secure: if your device is lost, stolen, or compromised, your history and coins may be accessible to whoever controls it.
The identifier is kept on your device and does not move to a new device. If it is lost — for example, when you switch to a new phone or reset your device — we may be unable to restore your coins or history. Subscriptions bought through Apple can generally be restored on another device with “Restore Purchases”; coins and history generally cannot be restored this way.
4. License
Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use the App on a device you own or control, solely for your own lawful, personal use. All rights not expressly granted are reserved.
5. Acceptable use — your core obligations
The Service can be misused in ways that harm others and break the law. You agree to use the Service only in compliance with all applicable laws and these Terms. In particular:
5.1 Photos of people
You may submit a photo in which a person can be recognized — whether for a face search, a similar-photos search, or a scan — only if:
- it is a photograph of yourself; or
- you have the consent of every identifiable person in it; or
- you otherwise have a lawful basis and the legal right to process that person’s image, including any facial or biometric data, in the way the Service does.
You are solely responsible for obtaining any consent or authorization required under applicable privacy and biometric laws (including the GDPR, the Illinois BIPA, the Texas CUBI, the Washington biometric statute, and similar laws) before submitting any image.
5.2 Prohibited uses
You must not use the Service, or any result it produces, to:
- stalk, harass, intimidate, threaten, surveil, dox, defame, blackmail, extort, or harm any person;
- identify, locate, or contact any person against their wishes, or help anyone else do so;
- search for, or submit photos of, anyone under 18 years of age in a face search or a similar-photos search;
- make or assist any decision regarding a person’s eligibility for employment, credit, insurance, housing, education, or any similar benefit or transaction. The Service is not a “consumer reporting agency,” and results are not “consumer reports,” under the U.S. Fair Credit Reporting Act (“FCRA”) or any analogous law, and you may not use the Service for any FCRA-regulated purpose;
- determine a person’s immigration status, or facilitate discrimination on the basis of race, ethnicity, religion, sex, gender, sexual orientation, disability, or any other protected characteristic;
- conduct surveillance on behalf of, or provide results to, any government, law-enforcement, or intelligence body, except where you are duly authorized and the use is lawful;
- submit images that are unlawful, that sexualize or exploit anyone, or that show a person in an intimate situation without their consent;
- submit documents or other images containing another person’s personal, financial, or identity information unless you are authorized to do so;
- violate any person’s privacy, publicity, biometric, intellectual-property, or other rights;
- violate the terms of service of any third-party platform whose content appears in results;
- scrape, harvest, bulk-process, or build any database from results, or use the Service to create or enrich any facial-recognition, identity, or image database;
- use bots, scripts, or other automated means to access the Service, or circumvent any usage limit, paywall, or security measure;
- reverse engineer, decompile, interfere with, overload, or attempt to gain unauthorized access to the Service or its providers;
- resell the Service or its results, or use the Service for any unlawful, deceptive, fraudulent, or malicious purpose.
5.3 Acknowledgment
You acknowledge that misuse of face-search and reverse image search technology can cause serious harm and may be a criminal offense or give rise to civil liability. You accept full responsibility for your use of the Service and for any consequences of that use.
6. Your representations, warranties, and indemnity
You represent and warrant, each time you use the Service, that: (a) you meet the eligibility requirements in Section 1; (b) you have all rights, consents, and lawful bases necessary to submit each image and to receive and use the results; and (c) your use complies with these Terms and all applicable laws.
Indemnification. To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless us, our affiliates, and our and their respective officers, employees, agents, and providers from and against any and all claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (i) your use or misuse of the Service or any result; (ii) your breach of these Terms; (iii) your violation of any law or of any third party’s rights, including any privacy, biometric, or publicity right; or (iv) any image you submit.
7. Purchases, subscriptions, and coins
7.1 Paid features
Some features — for example, a full face search, a full scan result, or similar photos of a person — are paid. You can pay for them with an auto-renewing subscription or with “coins.” Other features are free, may be subject to limits, and may change.
7.2 Subscriptions
Subscriptions (for example, weekly or monthly) are sold through Apple’s in-app purchase system. A subscription includes a set number of paid face searches and scans per billing period, as shown in the App when you subscribe; unused ones do not carry over to the next period. When your allowance for a period is used up, you can continue with coins.
- Payment is charged to your Apple ID account when you confirm the purchase.
- Your subscription renews automatically for the same period at the then-current price unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for the renewal within 24 hours before the end of the current period.
- You can manage or cancel your subscription in your Apple ID account settings on your device. Cancellation takes effect at the end of the current billing period, and you keep access until then.
- If a free trial is offered, any unused portion of it is forfeited when you purchase a subscription.
- Prices are shown in the App before you buy and may change; Apple notifies you of price changes as its rules require.
7.3 Coins
Coins are a consumable virtual item. A paid face search or a paid scan typically uses one coin (or one search from your subscription allowance). Coins are sold through Apple’s in-app purchase system in the bundles offered in the App, and may also be granted through promotions or the referral program (Section 7.8). Prices are displayed at the point of purchase and may change.
7.4 No cash value; non-refundable
Coins are a limited, revocable license to use a feature of the Service. Coins have no monetary value, are not redeemable for cash, cannot be transferred or resold, and are non-refundable except where required by applicable law or by Apple’s policies. Unused coins may be forfeited upon termination as described in Section 16.
7.5 Free previews and limits
Before you pay, the App may show a free teaser or an illustrative preview. A teaser of a scan shows part of the actual result — for example, the name and any safety warnings — and lists what the full result would add. A preview shown before a face search is paid for is an illustration of what a result screen looks like: it is not a search result and does not indicate whether any matches exist, or how many. We may limit the number of free teasers, descriptions, and other free features per device per day.
7.6 Failed requests
If a paid face search fails or finds no matches, or a paid scan fails, we automatically return the coin or subscription search it used. If that does not happen, contact us at support@scanny.online.
7.7 Apple processing, refunds, and consumption information
All purchases are processed by Apple under the Apple Media Services Terms and Conditions. We do not process payments and do not receive your payment-card details. Refund requests are handled by Apple in accordance with Apple’s policies; we generally cannot grant refunds directly. If Apple refunds a coin purchase, we may remove the coins from that purchase from your balance to the extent they have not been used.
When you request a refund from Apple for an in-app purchase, Apple may ask us for information about that purchase. You consent to us sharing with Apple — directly or through our subscription-management provider — information about that purchase and your use of the App (“consumption information”), together with our recommended resolution, so that Apple can evaluate your request. This may include how long your installation has existed, whether the purchased coins or features were used, an approximate measure of your in-app usage, and the approximate total value of your purchases and refunds in the App. It does not include your name, payment-card number, or any photo or result. This is described further in our Privacy Policy.
7.8 Referral program
The App may let you share an invite code. The person who redeems a code, and the person whose code it is, may receive coins as described in the App at the time. Each device can redeem only one code, and each code can be redeemed a limited number of times. We may change, suspend, or end the referral program at any time, and we may withhold or remove rewards obtained through fraud, self-referral, multiple installations, or other abuse.
7.9 Balances and changes
Your coin balance and subscription allowance are maintained on our servers, which are the source of truth. We may correct balances to remedy errors, fraud, or abuse. We may change the price, composition, or availability of coins, subscriptions, and features, or discontinue them, at any time, subject to applicable law.
8. No guarantee of results or accuracy; safety information
8.1 Results may be wrong
You understand and agree that:
- results are produced by automated systems — artificial-intelligence models, image-recognition and face-matching technology, and third-party databases and search services — and are inherently probabilistic and may be wrong, incomplete, outdated, or misleading;
- any identification, name, fact, description, translation, estimate, price, rating, address, or opening time shown in the App may be inaccurate, and confidence labels and similarity scores are not guarantees;
- a face-search match does not prove the identity, location, character, conduct, or affiliation of any person, a non-match does not prove their absence, and results may include different people who merely resemble the submitted face;
- prices, offers, and availability come from third-party shops and search services, may differ from what a shop actually charges, and are not offers from us;
- you must independently verify any information before relying on it, and you must never use results to harm or confront any person; and
- we do not control, endorse, or take responsibility for the third-party content surfaced in results.
We make no promise that the Service will identify any particular thing or person, or return any result at all.
8.2 Safety — do not rely on the App
- NEVER EAT OR TASTE A WILD MUSHROOM, PLANT, BERRY, OR ANY OTHER POTENTIAL FOOD, AND NEVER HANDLE A POTENTIALLY DANGEROUS PLANT, INSECT, OR ANIMAL, BASED ON AN IDENTIFICATION OR SAFETY NOTE FROM THE APP. Poisonous and dangerous species can look almost identical to harmless ones, and the absence of a warning does not mean that something is safe.
- If you suspect poisoning, a bite or sting, or an allergic reaction, contact your local emergency number or a poison control center immediately.
- Nutrition, calorie, and allergen information is a rough estimate and is not medical, dietary, or nutritional advice.
- Values of coins, banknotes, collectibles, and artworks are indicative estimates, not appraisals or authentication. Do not rely on them when buying, selling, or insuring anything.
- Text readings and translations may contain errors. Do not rely on them for medical, legal, safety-critical, or other important matters, such as medication labels or contracts.
- Information about places, such as addresses, opening hours, and entry prices, may be out of date.
- Nothing in the Service is professional advice — medical, veterinary, legal, financial, or otherwise.
9. Third-party services and content
The Service relies on and links to third-party services and content, including artificial-intelligence and image-analysis providers, face-search, reverse image search, and visual search providers, identification databases and reference sources, Apple’s services, hosting, storage, subscription-management, and analytics providers, and the third-party websites, shops, and profiles that appear in results. Images in results may be loaded directly from the websites that host them. Your use of third-party services and websites is subject to their own terms and privacy policies. If you buy anything from a shop you reach through the App, that purchase is solely between you and the shop. We are not responsible for third-party services or content and disclaim liability arising from them.
10. Intellectual property and your photos
The Service, including its software, design, text, graphics, logos, and the App’s names and marks, is owned by or licensed to us and is protected by intellectual-property laws. Except for the license in Section 4, these Terms do not grant you any right in our intellectual property.
You retain whatever rights you hold in the photos you submit. You grant us a worldwide, non-exclusive, royalty-free license to host, copy, transmit, process, and display those photos, and to send them to our service providers, solely to provide the Service to you, as described in the Privacy Policy. You are responsible for the photos you submit and must have the rights needed to submit them. Results may include third-party content (images, text, and links) that belongs to its owners; you may use results only for your own lawful, personal purposes under these Terms.
11. Privacy
Our collection and use of personal information, including information that some laws treat as biometric, is described in our Privacy Policy, which is incorporated into these Terms by reference. By using the Service you consent to that collection and use.
12. Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL RESULTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT RESULTS — INCLUDING IDENTIFICATIONS, SAFETY INFORMATION, ESTIMATES, AND PRICES — WILL BE ACCURATE OR RELIABLE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- IN NO EVENT WILL WE, OUR AFFILIATES, OR OUR PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR REPUTATION, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, WHETHER IN CONTRACT, TORT, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
- OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD 50.
SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF CERTAIN LIABILITY, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED BY LAW, INCLUDING LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, OR FOR FRAUD.
14. Assumption of risk
You acknowledge that automated recognition and search technology carries inherent risks, including the misidentification of species, objects, places, or text, inaccurate safety information, false face matches, and results that point to the wrong person. You assume all risk arising from your use of the Service and your reliance on any result, and you agree that, as between you and us, you are solely responsible for your conduct and its consequences.
15. Suspension and changes to the Service
We may modify, suspend, or discontinue the Service or any part of it, temporarily or permanently, with or without notice, and we may impose limits on certain features. We will not be liable to you for any such modification, suspension, or discontinuation, subject to applicable law and Section 7.
16. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or applicable law, or to protect the Service, other users, or third parties. You may stop using the Service at any time by deleting the App. Upon termination: your license under Section 4 ends; unused coins may be forfeited without refund except as required by law; and Sections 5–6, 8–14, 17–22, and any provision that by its nature should survive, will survive.
17. Governing law
These Terms and any dispute arising out of or related to them or the Service are governed by the laws of the Republic of Uzbekistan, without regard to conflict-of-laws rules, except to the extent that mandatory consumer-protection laws of your country of residence apply.
18. Dispute resolution; arbitration; class-action waiver
PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.
18.1 Informal resolution
Before bringing a formal proceeding, you agree to first contact us at support@scanny.online and attempt to resolve the dispute informally for at least 30 days.
18.2 Binding arbitration
Except where prohibited by law, any dispute that is not resolved informally will be resolved by final and binding arbitration before a single arbitrator, administered by an established arbitral institution in the country whose laws govern these Terms under Section 17, under that institution’s rules then in effect, and seated in that country. The arbitration will be conducted in English. Judgment on the award may be entered in any court of competent jurisdiction.
18.3 Class-action waiver
You and we agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. The arbitrator may not consolidate more than one person’s claims.
18.4 Exceptions
Either party may bring a claim in small-claims court, and either party may seek injunctive relief in court to protect intellectual-property or confidential information. You may opt out of this arbitration agreement by notifying us at support@scanny.online within 30 days of first accepting these Terms.
18.5 Consumer rights
If you are a consumer resident in the EEA, the UK, or another jurisdiction whose mandatory law prohibits pre-dispute arbitration or class waivers, this Section applies only to the extent permitted by that law, and you retain the right to bring proceedings in the courts of your place of residence.
19. Apple App Store — additional terms
These Terms are between you and us only, and not with Apple Inc. (“Apple”). You acknowledge that:
- Apple has no obligation to furnish any maintenance or support for the Service;
- Apple is not responsible for any product warranties, whether express or implied; in the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App, and to the maximum extent permitted by law Apple has no other warranty obligation;
- Apple is not responsible for addressing any claims by you or any third party relating to the Service, including product-liability, regulatory-compliance, or consumer-protection claims;
- Apple is not responsible for the investigation, defense, settlement, or discharge of any third-party intellectual-property infringement claim relating to the Service;
- you must comply with applicable third-party terms (including the App Store Terms of Service) when using the Service; and
- Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you.
You represent that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist-supporting,” and that you are not on any U.S. Government list of prohibited or restricted parties.
20. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date and, where required, provide notice within the App. Changes take effect when posted (or as otherwise stated). Your continued use of the Service after changes take effect constitutes acceptance. If you do not agree to the updated Terms, stop using the Service.
21. General
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service and supersede prior agreements.
- Severability. If any provision is held unenforceable, the remaining provisions remain in effect, and the unenforceable provision will be enforced to the maximum extent permissible.
- No waiver. Our failure to enforce any provision is not a waiver of it.
- Assignment. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, sale of assets, or transfer of the Service.
- No agency. Nothing in these Terms creates any partnership, agency, or employment relationship.
- Force majeure. We are not liable for any delay or failure caused by events beyond our reasonable control.
- Language. These Terms are drafted in English; any translation is provided for convenience, and the English version controls where permitted by law.
